| A | MTN does not trace stolen handsets. However, and in the event that the theft is associated with a serious
and violent crime ( hijacking/ robbery/ murder/ rape etc) request further information ( tracing/ location
information/ usage) from MTN. Such information can only be released to a police officer who requests
such information via a Section 205 subpoena. In the instance of an emergency such as missing person/
kidnapping/ hijacking), this information can only be released to a police officer.
The subscriber must then immediately report the matter to the police. There are processes in place which
enable the investigating officer from SAPS to obtain the required information (tarcing/ location
information) on an urgent basis.
The process is that the investigating officer can contact his/ her technical support unit to facilitate an
urgent request to MTN for the information that is required. MTN has personnel on standby 24/7 that
will then upon receiving the required request from the Technical Support Unit process the request and
furnish the information to enable the tracing of the victim/ missing person. This is however only used in
immediate threats to life and limb. These processes are governed by the Regulation of Interception Act
(RICA) |
